These Terms of Sale apply to purchases from Forge Containers ("Forge," "we," "us," or "our"), through forgecontainers.com or a quote issued by our team. They cover shipping containers and the related products and services identified in your order, including modified units, cabins, trailers, pools, flat-pack products, and accessories where offered.
Our Shipping & Delivery Policy and Returns & Refund Policy form part of these terms. Our Privacy Policy explains how we handle personal information. Please read these documents before placing an order and retain your quote, order correspondence, and invoice.
1. Quotes, order requests, and acceptance
You can request a quote or add eligible products to your cart and select Place order. Submitting an order request sends your product selections and delivery details to our team. It does not charge a payment method or, by itself, create an accepted sales contract. A cart does not reserve inventory.
An automated receipt, reference number, or email containing payment instructions acknowledges your request. We accept an order when our team expressly confirms acceptance in writing after reviewing availability, specifications, delivery arrangements, and payment requirements. We will identify any inventory reservation and its expiry in that confirmation. An automated reference to a reservation does not establish an indefinite hold.
A written quote is valid for the period stated on it. We will confirm any change needed after that period before accepting your order. If a product, selected finish, or price has changed, we will explain the change and obtain your agreement before proceeding. We will not substitute a different product or increase an accepted price without your agreement.
We may decline a request before acceptance if we cannot supply it, cannot safely deliver it, identify a material error, or reasonably suspect fraud. We will return any payment received for an order we decline. Once an order is accepted, cancellation and refund rights are governed by these terms and our Returns & Refund Policy.
2. Prices, discounts, and tax
Prices are in U.S. dollars. An exact product price applies to the listed specification; a price marked "from" is a starting price, and a quote-only product requires an individual quote. These different price types are not interchangeable.
The order summary itemizes merchandise, any applicable quantity discount, delivery, estimated tax, and the total. Standard delivery shown as included carries no separate standard-delivery charge. Expedited delivery is an optional charge shown before submission. Permits, foundations, utility connections, assembly, and other site work are included only when expressly listed in your accepted scope.
Quantity discounts shown in the cart apply to the qualifying quantity of the same product. We will show the effect of a requested quantity change before you approve it.
Tax shown during the order-request process is an estimate. The final invoice must reflect the tax applicable to the transaction and delivery destination. We will explain any correction and obtain your agreement before collecting a changed total. If you claim an exemption, provide the supporting documentation before invoicing. Where we are not required to collect a tax, you may have a separate obligation to report or pay it.
3. Payment by bank transfer
Website orders are paid by bank transfer using the instructions supplied by our team. The website does not take credit-card or debit-card payments, collect your bank login, or initiate a withdrawal from your account. Include your order reference with your transfer so we can match it to the invoice.
The invoice specifies when payment is due. Any deposit, staged payment, or alternative payment arrangement must be agreed in writing before you pay. We schedule dispatch after the required payment is received and cleared, subject to the shipment obligations in our Shipping & Delivery Policy.
Before paying, check that the beneficiary and amount match the verified invoice. If you receive changed banking instructions or a request to pay a different beneficiary, stop and contact us through our contact page using a previously verified contact method. We will help verify the instructions. This precaution does not transfer responsibility for our own errors or misconduct to you.
4. Product specification and condition
Your order must identify the product, quantity, dimensions or size designation, condition, selected finish where applicable, and any agreed modifications. Tell us before ordering if a particular clearance, load, electrical supply, temperature range, or intended use is essential to your purchase.
New or one-trip containers. A one-trip container has been used for an initial transport journey and may have handling marks. "One-trip" does not mean untouched or cosmetically flawless.
Used, refurbished, and as-is products. The description and disclosed condition govern what we agree to supply. Used units can have dents, corrosion, patches, paint differences, and other wear. A refurbishment covers the work described in the listing or agreed scope; it does not automatically mean every component is new. An as-is designation does not excuse delivering a different product, concealing a known material defect, or failing to meet an express description.
Condition grades. Wind and watertight describes protection against wind and rain in the stated condition; it is not a promise against condensation, flooding, or damage from unsuitable placement. A cargo-worthy description does not, by itself, provide a current shipping inspection, carrier acceptance, or certification for your intended voyage. Any required inspection or certificate must be identified in the order.
Photographs and finishes. We distinguish an identified unit from a product offered by specification or grade. Where imagery represents a type of product, we will identify material differences before acceptance. A selected finish is part of your requested specification; screen appearance can vary, but we will not replace your selected finish with another without agreement. Accessories or furnishings shown in a setting are included only when listed.
5. Modified products and intended use
For custom work, the written scope must identify the drawings or specifications, included work, price, payment stages, and expected schedule. Approve that scope before work begins. Changes require a written agreement covering their cost and timing.
Unless expressly included, a product sale does not include planning permission, engineering design, foundation construction, installation, utility work, occupancy approval, or vehicle registration. You are responsible for obtaining the approvals required for your site and use; we remain responsible for any work or compliance obligation we expressly undertake.
A cabin, container office, pool, or other modified structure is not represented as approved for occupancy or installation in every jurisdiction. A trailer or chassis is not represented as registered or approved for road use in your state merely because it appears in the catalog. Confirm the required documentation and included services before ordering. Refrigerated and powered equipment must be used with the specified supply and operating requirements.
6. Delivery, ownership, and risk
When we arrange delivery, risk of loss remains with us until the product has been unloaded at the agreed delivery point and made available to you or your authorized representative. Ownership transfers when both delivery and the required payment are complete.
If we agree that you will collect the product or appoint your own carrier, the written pickup arrangement will identify the location, loading responsibility, and handover point. Risk transfers at that agreed handover. Signing a delivery receipt acknowledges receipt; it does not waive a valid claim for a concealed defect or other rights that cannot lawfully be waived.
The site-access, inspection, and delay procedures appear in our Shipping & Delivery Policy.
7. Warranties and product problems
We are responsible for supplying products that match the agreed description and any express commitments made as part of the sale. Report damage, an incorrect item, or a suspected defect under our Returns & Refund Policy.
If a product includes a separate written limited warranty, we will make its terms available before purchase. That document must identify the warrantor, covered product and components, duration, exclusions, claim process, and remedy. A manufacturer's warranty is provided by the named manufacturer; it does not replace any obligation we owe you as seller.
There is no additional uniform warranty period for every item in our catalog under these terms alone. Any product-specific warranty we advertise or agree to remains applicable. Nothing here removes an implied warranty or other protection that applicable law does not allow us to exclude. In particular, an as-is label does not override an express warranty or an applicable restriction on disclaiming implied warranties when a written consumer warranty is provided.
8. Liability and events outside our control
For business purchases, to the extent permitted by law, our aggregate liability arising from the affected order is limited to the amount paid for that order, and we exclude liability for indirect or consequential business losses, including lost profit or business interruption.
These limits do not restrict a refund, repair, replacement, or other remedy expressly promised in these policies; liability for fraud, willful misconduct, or gross negligence; liability for personal injury or property damage caused by our negligence; or any right or liability that cannot lawfully be limited. Consumer purchases retain all applicable mandatory protections.
Severe weather, road closures, carrier disruption, and other events outside our reasonable control may affect performance. We will notify you and explain the available next steps. Such an event does not allow us to retain payment indefinitely, disregard an agreed change, or avoid a required cancellation or refund.
9. Which documents apply
A separately negotiated agreement signed or expressly accepted by both parties controls a conflict with these standard terms only to the extent it specifically addresses that conflict and is lawful. Otherwise, these terms and the linked delivery and returns policies govern the order. An invoice cannot introduce undisclosed restrictions after you have agreed to buy. Your purchase-order terms apply only if we expressly accept them.
The policy version disclosed when your order is accepted continues to govern that order. A later website update does not reduce your existing rights. Disputes are handled under the applicable-law and dispute provisions in our Terms of Service, subject to mandatory consumer protections.
