These Terms of Service govern use of forgecontainers.com, operated as Forge Containers ("Forge," "we," "us," or "our"). They apply to browsing our catalog, using the cart, requesting a quote, and contacting us through the website. Purchases are governed by our Terms of Sale, including the linked Shipping & Delivery Policy and Returns & Refund Policy.

By using the website, you agree to these terms to the extent an enforceable agreement is formed under applicable law. If you do not agree, please stop using it. Our Privacy Policy explains our information practices; it is not a blanket consent to marketing or tracking.

1. Eligibility and authority

You must be at least 18 and legally able to enter a contract to place an order or authorize work. If you act for a company, property owner, or another buyer, you must have authority to provide their information and make the commitments you submit. Provide accurate contact and delivery details so we can respond and assess the request.

2. What the website offers

The website presents containers and related products, specifications, guides, quotes, and an order-request process. You can browse without creating an account. A saved cart is a convenience and does not hold stock, preserve a price indefinitely, or create a purchase contract.

Where an exact price is displayed, it relates to the listed product and specification. Starting-price and quote-only listings are identified separately. Product availability can change; order acceptance and any necessary correction are handled under our Terms of Sale. We do not use these terms to disregard an agreed product description or change an accepted price without your agreement.

Selecting Place order submits a request to our team. No payment is taken on the website. We supply bank-transfer instructions separately and confirm the accepted order in writing. Keep your reference number and contact us if you do not receive the expected correspondence.

3. Guides, specifications, and project decisions

Our guides explain common container uses, conditions, delivery considerations, and site preparation. General guidance does not replace a site inspection, engineering design, a licensed contractor's advice, or a determination by your permitting authority.

Verify dimensions and required clearances for the specific product before committing to a foundation, crane booking, utility connection, road-use arrangement, or occupancy plan. Ask us to confirm any specification essential to your project in writing. These precautions do not excuse inaccurate product representations or work we expressly agree to perform.

4. Permitted use and website content

You may browse, download, and share reasonable extracts of product information to evaluate a purchase for personal use or your business, including with advisers and colleagues. Keep relevant source and copyright notices intact. Website text, photographs, logos, and other materials remain the property of Forge or their respective owners.

You may not reproduce the catalog for resale, impersonate Forge, misrepresent our affiliation with another business, or use our trademarks in a misleading way. These restrictions do not limit fair use or other rights provided by law.

5. Misuse and submitted information

Do not use the website to submit fraudulent requests, send malware, harass others, overload or disrupt the service, evade security controls, access nonpublic systems, or harvest personal information without authorization. We may restrict access reasonably necessary to prevent misuse or protect the service. A restriction does not cancel our obligations under an existing purchase.

When you send drawings, photographs, specifications, or messages, you confirm that you have permission to provide them. You allow us to use and share them as reasonably needed to assess, quote, fulfill, or support your request. This is not permission to publish your project or use your materials in advertising without separate authorization.

6. Third-party services and intellectual-property concerns

Links to other websites, maps, messaging platforms, or manufacturer materials may be provided for convenience. Those services have their own terms and privacy practices. A link does not establish that we control or endorse all of their content.

If you believe material on this website infringes your rights, email sales@forgecontainers.com with the subject Content complaint, identify the material and its URL, explain your rights, and provide contact details. We will review the complaint. This contact is not a representation that Forge has registered a designated DMCA agent.

7. Website availability and limitations

We take reasonable care in operating the website but cannot promise uninterrupted access or that every technical function will be error-free. Maintenance, network issues, or provider outages may interrupt access. Where lawful, the website itself is provided on an "as available" basis without an additional warranty of uninterrupted operation.

We are not responsible for loss caused solely by your unlawful misuse of the website. Nothing in these terms excludes liability for fraud, willful misconduct, gross negligence, or any liability that cannot lawfully be excluded. These website provisions do not limit a product warranty, an agreed specification, a refund obligation, or your mandatory consumer rights. Liability relating to a purchase is addressed in the Terms of Sale.

8. Electronic correspondence

We ordinarily handle quotes, order requests, invoices, and delivery updates by email and other agreed contact methods. Keep your contact details current and retain copies of the terms and correspondence relevant to your order. Tell us if you need an alternative means of receiving a document.

This provision does not replace any separate disclosure, consent, or paper-copy right required for a particular electronic record. Service correspondence does not automatically enroll you in promotional calls, texts, or emails.

9. Applicable law and disputes

These terms are governed by the laws of the State of Ohio, subject to any mandatory protections that apply where you reside. A choice of law does not deprive a consumer of protections that cannot lawfully be waived.

Please contact sales@forgecontainers.com with a description of a dispute and the relevant order reference so we can try to resolve it. Informal contact is encouraged but is not a condition to seeking urgent relief, making a regulator complaint, filing a timely claim, or using a court with jurisdiction.

These terms do not impose mandatory arbitration, a class-action waiver, a jury-trial waiver, or an exclusive out-of-state court requirement. Any dispute may be brought before a court with jurisdiction, subject to applicable law.

10. Changes and general provisions

We may revise these website terms prospectively and post the updated effective date. We will provide any further notice or obtain assent required by law. Changes do not retroactively alter an accepted order or an accrued right.

If a provision is unenforceable, the remainder continues to apply to the extent permitted by law. A failure to enforce a provision once is not a permanent waiver. An assignment or business transfer does not remove our obligations to you or reduce mandatory consumer protections.

These terms address website use; the Terms of Sale and any accepted, specific agreement govern purchases. The Privacy Policy describes information practices rather than expanding your purchase obligations.
